TERMS AND CONDITIONS
In-Person Events

This document outlines the terms and conditions (the “Terms”) governing the relationship between Womben Wellness, LLC (“WW”) and the Client for all in-person events, including but not limited to retreats, intensives, day events, and weekend gatherings. By completing a booking with WW, the Client acknowledges having read and understood these Terms and agrees to be bound by them.

A. THE BOOKING CONTRACT

A booking is confirmed, and these Terms apply when WW, or an authorized agent acting on WW’s behalf, has received the applicable payment from the Client and the Client has received written confirmation from WW of such booking.

B. PAYMENT

i. Payment Plans and Pricing

  • Clients may choose to pay in full or according to an installment plan offered at the time of booking.

  • Payment plan installments will be automatically charged to the same credit card according to the selected pricing plan.

ii. Discounts

  • WW offers promotional discounts, including Super Early Bird and Early Bird rates. These discounts are time-sensitive and subject to availability. All discounts are applied at the time of registration and cannot be combined with other offers unless otherwise stated.

iii. Payments:

  • For pay-in-full bookings, the full balance is due at the time of booking.
  • For installment plans, payments will be charged automatically according to the plan selected at the time of booking.
  • All installments must be completed no later than the program start date.
  • If a scheduled payment fails, the Client will be notified and has 7 days from the due date to correct the payment. If payment is not received within this time, WW reserves the right to cancel the booking and release the Client’s spot. Any refund in such cases will be determined in accordance with the Cancellation Policy below.
  • If booking occurs less than 30 days before the program start date, the full balance is due at the time of booking.

iv. Client Details:

As a condition of valid booking confirmation, the Client must provide all necessary information as requested by WW along with their final payment. If the Client fails to provide this information prior to 30 days before the event start date, WW reserves the right to treat the booking as canceled and levy any cancellation fees deemed reasonable by WW.

C. CANCELLATION

i. By Client:

Any cancellation must be delivered to WW in writing and acknowledged by WW in writing. The applicable cancellation policy is as follows:

Womb Healing Retreat

  • Within 7 days of booking: 100% refund of all payments made, regardless of the event start date.

  • After 7 days of booking: No refund. Installment plans stop charging.

Womben Gone Wild Weekend Getaway

  • All sales are final. No refunds will be issued.

WW strongly recommends that Clients purchase travel insurance at the time of booking to protect against unforeseen circumstances such as personal medical emergencies or a death in the family. See Section K (Insurance) for more details.

ii. By Womben Wellness, LLC:

WW will not cancel a confirmed booking except in cases of Force Majeure, defined as unusual or unforeseen circumstances outside of WW’s reasonable control. If WW cancels an event due to Force Majeure, the Client will receive a full refund of all monies paid.

WW is not responsible for any incidental expenses or consequential losses the Client may have incurred as a result of a canceled booking, including but not limited to non-refundable flights, independent hotel bookings (where accommodation is not part of the paid program), visas, vaccinations, loss of earnings, or loss of enjoyment.

D. UNUSED SERVICES

WW will not offer refunds or discounts for missed or unused services where the absence is due to no fault of WW, its agents, or representatives, including any termination of participation due to the Client’s own fault, negligence, or breach of these Terms.

E. FLEXIBILITY

By booking with WW, the Client acknowledges that the nature of in-person events may require flexibility and accepts that WW may make reasonable alterations to the program or itinerary. Schedules, amenities, venues, and activities may change without prior notice due to circumstances including but not limited to illness, incidents at the event location, extreme weather, political events, flight cancellations, strikes, or other unforeseeable events outside WW’s reasonable control.

F. MEDICAL CONDITIONS AND SPECIAL REQUIREMENTS

WW cannot offer advice of a medical nature. Some WW events may take place in remote or isolated locations with limited access to medical facilities, or facilities that differ from standards the Client is accustomed to in their home country.

All Clients should consult their physician regarding their fitness for participation. It is the Client’s responsibility to assess the risks and requirements of each program in light of their own physical and mental health, fitness, and any medical requirements. WW makes no representations regarding the standard of medical facilities available.

WW will endeavor to accommodate special requests, including dietary and accommodation needs, but such requests do not form part of these Terms and WW is not liable for any failure to accommodate them.

G. ACCEPTANCE OF RISK

THE CLIENT ACKNOWLEDGES THAT WW PROGRAMS MAY INVOLVE A SIGNIFICANT AMOUNT OF RISK TO THE CLIENT’S HEALTH AND/OR SAFETY. TO THE FULL EXTENT PERMISSIBLE BY LAW, THE CLIENT ASSUMES ALL SUCH RISK AND RELEASES WW FROM ALL CLAIMS AND CAUSES OF ACTION ARISING FROM ANY DAMAGES, INJURIES, OR DEATH RESULTING FROM RISKS INHERENT IN TRAVEL, PRACTICING YOGA, SACRED CEREMONY, VISITING LOCATIONS, AND PARTICIPATING IN ACTIVITIES INCLUDED IN WW PROGRAMS.

Activities, accommodation, transportation, and other components of WW events will be arranged with local suppliers, who may themselves engage local operators or subcontractors. Standards of hygiene, accommodation, and transport may differ from what the Client expects in their home country. WW endeavors at all times to appoint reputable and competent local suppliers and to comply with all applicable health and safety laws in the regions where events operate.

The terms and conditions of all suppliers are expressly incorporated into these Terms. These may limit or exclude supplier liability. WW’s liability will not exceed that of any relevant supplier.

H. LIABILITY

WW is not responsible for any damages, expenses, losses, or claims attributable to the fault of any Client, the unforeseeable or unavoidable act or omission of an unconnected third party, or a Force Majeure event.

Force Majeure: WW shall not be liable for death, bodily injury, illness, damage, delay, or other loss or detriment to person or property caused by Act of God, war or warlike operations, mechanical breakdown, terrorist activity or threat thereof, civil commotion, labor difficulties, interference by authorities, political disturbance, riot, insurrection, government restraint, fire, extreme weather, or any other cause beyond WW’s reasonable control, or any event which WW or the supplier of services could not foresee even with all due care.

WW shall not be liable for any loss or anticipated loss of profit, loss of revenue, loss of use, loss of contract, or other consequential or indirect loss. For claims not involving personal injury, death, or illness, WW’s liability is limited to a maximum of the price paid by the Client for the program, excluding insurance premiums and administration charges. WW will not be liable for loss of or damage to valuables of any nature.

By agreeing to these Terms, the Client acknowledges that WW practitioners do not diagnose conditions, prescribe medication, or provide medical treatments. WW programs are educational in nature and do not replace the advice of a qualified healthcare practitioner. The Client agrees to continue any medication or treatment prescribed by their licensed physician and releases WW, its owners, and practitioners from all legal liability during their participation in WW programs.

THE CLIENT MUST COMMUNICATE IN WRITING TO WW, AT THE EARLIEST OPPORTUNITY, ANY FAILURE OR ISSUE THEY ALLEGE HAS OCCURRED.

I. CLIENT RESPONSIBILITY

The Client must at all times comply with all applicable laws and regulations of all locations visited as part of a WW program. Should the Client fail to comply, commit any illegal act, or behave in a way that causes or is likely to cause danger, distress, or material annoyance to others, WW may terminate that Client’s participation immediately without liability and without entitlement to any refund for unused or missed services.

Clients are responsible for any costs incurred by WW or its suppliers as a result of damage, destruction, theft, or excess cleaning fees related to the Client’s use of accommodation, transport, or other facilities. Any pre-existing damage must be reported to the relevant staff or WW representative as soon as it is discovered.

The Client agrees to take all prudent safety measures while participating in any WW program, including proper use of safety devices such as seatbelts, harnesses, and helmets, and compliance with all posted signs and warnings. WW shall not be liable for any failure on the Client’s part to comply with these recommendations.

WW is not responsible for providing guidance on local customs, weather conditions, safety concerns, physical challenges, or laws in any location where programs are operated. Clients are strongly encouraged to contact their local embassy or consulate before traveling.

J. DISMISSAL

WW reserves the right to dismiss any participant who has violated any conditions for participation, has become a hindrance to the group process or the integrity of the program, or has an active and contagious health condition. Dismissal under these circumstances will be without refund.

K. TRAVEL DOCUMENTS

For international programs, the Client is entirely responsible for securing and holding a valid passport and all required visas, permits, vaccination certificates, and insurance policies necessary for entry, travel, and re-entry to their country of residence. Passports must be valid for at least 6 months past the last date of travel with WW.

Clients should consult the Center for Disease Control (CDC) and/or their local travel doctor for information on any recommended vaccinations for WW program destinations.

All travel documents, vouchers, itineraries, and invoices will be sent electronically to the email address provided at the time of booking, upon receipt of full payment.

L. INSURANCE

International / Retreat Programs

For all international programs and multi-day retreats, travel insurance is mandatory. Clients must obtain travel insurance with a minimum of US$200,000 in medical, evacuation, and repatriation coverage, covering all applicable travel dates. This insurance must cover personal injury and emergency medical expenses. A copy of the insurance policy must be emailed to support@wombenwellness.com before the event start date.

It is strongly recommended that Clients also extend coverage to include cancellation, curtailment, and all other expenses that might arise from loss, damage, injury, delay, or inconvenience.

Local / Domestic Events

Travel insurance is not required for domestic day events or local weekend programs. However, WW strongly encourages all Clients to carry personal health insurance and consider event cancellation coverage to protect against unforeseen circumstances.

WW shall have no liability for loss, theft, or damage to baggage or personal effects at any event. Clients are responsible for their own belongings at all times and should not leave personal items unattended in public areas, transportation, or event facilities.

M. EMERGENCY MEDICAL CARE

In the event that the Client or any member of their group requires emergency medical care, hospitalization, or surgery while participating in a WW program, the Client authorizes WW leadership, through its representatives, to secure any necessary treatment. If coverage is not provided through the Client’s travel insurance, such treatment shall be solely at the Client’s expense. WW may notify the Client’s emergency contact in any emergency situation.

N. DISCOUNTS AND PROMOTIONS

All discounts and promotional pricing are applied at WW’s sole discretion. Reduced pricing applies strictly to new bookings. Bookings already confirmed (where at least a deposit has been received) are not entitled to subsequently offered reduced pricing.

O. CLAIMS AND COMPLAINTS

Clients agree to bring any complaints to WW’s attention as soon as possible to give WW the opportunity to address them properly. WW assumes no liability for complaints not properly communicated to WW with sufficient notice. The Client must inform their designated WW representative at the earliest opportunity.

P. SUPPLIERS

Accommodation, transportation, catering, and other event components will be arranged by WW with local suppliers, who may engage local operators or subcontractors. WW will endeavor at all times to appoint reputable and competent local suppliers. The terms and conditions of all suppliers are incorporated into these Terms, and the Client assents to those terms. WW’s liability will not exceed that of any relevant supplier. Neither WW nor any carrier is liable for the acts or omissions of independent contractors.

Q. SEVERABILITY

If any term or condition herein is found to be unenforceable or void, it shall be severed or amended only to the extent necessary to allow all remaining terms to survive and continue as binding. The invalidity of any provision shall not affect the validity or enforceability of any other provision.

R. MEDIA RELEASE

By agreeing to these Terms, the Client consents to WW, its employees, officers, or agents taking photographs, video, or digital recordings during any WW event, and to the use of these in any and all media, now or hereafter known, exclusively for WW purposes. The Client’s name and identity may be revealed in descriptive text or commentary. The Client releases to WW, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately, and to market and sell copies. The Client waives any rights, claims, or interests in controlling the use of their identity or likeness in whatever media is used. No financial or other remuneration will be provided for recordings made.

S. CONFIDENTIALITY

Audio and video recording of any part of a WW program may only be carried out by WW administrators. Any form of recording by participants is prohibited during the program.

To maintain a safe environment, the sharing and personal process of other participants remains strictly confidential unless express permission is given by those participants.

T. GOVERNING LAW

These Terms are subject to the laws of the State of Oregon, USA. Any dispute arising between the parties will be heard and/or litigated only in a court of competent jurisdiction sitting in Jackson County, Oregon, USA.

U. CONTRACT PARTIES, SUCCESSORS AND ASSIGNS

These Terms shall inure to the benefit of and be binding upon WW and the Client and their respective heirs, legal personal representatives, successors, and assigns, as well as anyone named in any booking made by the Client on whose behalf the Client is purchasing any WW program.
